These terms of use (“Terms of Use”) set forth the agreement (“Agreement”) between you and AposBook (“AposBook” “we” or “us”). It governs your use of the services we offer through our platform (“Platform”).

Whether you reside in the “European Union” (EU), “European Economic Area (EEA),” or Switzerland or outside of it, you are entering into an agreement with AposBook Inc. (“AposBook Inc.”). We will be the controller of your personal data provided to, or collected by or for, or processed in connection with our Services.

Read these terms carefully because by using AposBook, you agree to be bound by these “Terms and Conditions of Use” and by our “Privacy Policy.” You also confirm that you have read our “Editorial Policy” and “Cookie Policy.”

If you disagree with any part of the terms, you may not use our services.

The contents of the “Platform,” such as text, graphics, images, and other materials created by AposBook and other materials contained on Aposbook.com (“Content”) that we provide is for personal information and educational purposes only.

We do not provide medical advice. Always seek medical assistance from medical and healthcare experts. Never ignore professional medical advice or delay seeking treatment because of something you have heard about or read on Aposbook.com. The use or reliance of any information contained on this “Platform” is solely at your own risk.

1- Using Our Services

To use our Services, you agree that:

  • You must be at least 15 years old
  • Your account must be in your real name

2- Your Account

To use certain features of our Services, you may be required to create an AposBook account (an “Account”) and provide us with information about yourself as outlined in our Privacy Policy.

Therefore, you agree that:

  • You are not allowed to license, sell, or transfer your Account.
  • You are responsible for the information associated with your Account. Therefore, you agree to follow our “Code of Conduct.”
  • You are responsible for maintaining the security of your Account, so we recommend that you use a strong password to keep it secure. Never disclose your password to any third party.
  • You must immediately notify AposBook if you discover or suspect that someone has accessed your Account without your permission.

2.1 Account Registration

To register for an account, you must provide your name and email address; otherwise, you cannot use our Services. We will send you a validation link to confirm that the email address is active and belongs to you.

Once you validate your email address, we will activate your account. When you register for an account, we recommend that you use your legal name to prevent fraud and promote authenticity on the platform.

You have the option of choosing an alias or nickname when you register. If you want to discuss something personal, but you do not want to reveal your real name to others, you can choose to post “as anonymous”.

This option will allow you to protect your personal identity and only display your alias. Bear in mind that our members should be authentic and transparent at all times, especially when they choose to post anonymously. Do not abuse this option to promote false information of any kind. 

3- Your Content

Our Services allow you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material (“Content”).

You are responsible for the Content you share on our Service. We take no responsibility for, and we do not endorse any of your Content in any way.

By submitting your “Content” to AposBook, you represent and warrant that you have all rights, power, and authority necessary to grant the rights to your “Content” contained within these Terms. If you post or share “Content” without all necessary rights, you may be held liable for it.

You retain any ownership rights to your Content, but you grant AposBook a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, transferable, and sublicensable license to use that Content:

  • When your Content is posted on our “Platform”, you grant us the license to use, copy, modify, adapt, distribute, and display your “Content” and any name or alias provided in connection with your Content in all media formats.
  • We do not edit your Content in any way. However, we reserve the right to delete or remove your Content at any time and for any reason, if you:

- Violate these Terms

- Violate our Editorial Policy

- Create liability for us

3.1 Feedback

You agree that AposBook may use any feedback you give without compensating you for it.

4- Our License to You

We grant you a personal, non-transferable, non-exclusive, revocable, limited license to use and access the Services. You agree not to misuse our Services in any way.

Our license to you does not give you the right to:

  • License, sell, distribute or commercially exploit the Services or Content in any way.
  • Modify, prepare derivative works of, disassemble, decompile, or reverse engineer any part of the Services or Content.
  • Access our Services to build a similar or competitive website, product, or service offering.
  • Publish Content that violate the “Terms of Use” and Code of Conduct” on the platform

5- Intellectual Property

All of the materials posted on this platform are protected by copyright laws. In the United States, copyright laws are stipulated under the Digital Millennium Copyright Act (“DMCA”). We respect the intellectual property rights of others and expect our users to do the same.

Disclaimer:

If you are not sure that you have the proper permission to share copyrighted content, you should consult a lawyer. We do not provide you with legal advice.

 5.1 Our Content

 You may not violate AposBook’s intellectual property or other related rights. 

As such, you may NOT:

  1. Copy or distribute our publications, videos, or other materials without using our logo “©2020, AposBook, LLC. All rights reserved” and other copyright and proprietary rights notices that are contained in the Content.
  2. Use the word “AposBook” or our logos in any business name, email, or URL

5.2 Your Content

Also, you may not violate the copyright or intellectual property of other members or third parties on this Platform.

Therefore, always make sure that you:

  • Have all the necessary rights before you submit your material to our Services.
  • Do not infringe on other people’s copyrighted material if you share it on our Services

If your content has been posted on our platform and you have any special attribution requirements that you may find missing or incomplete, you can contact us at info@aposbook.com, and we will make sure to attribute your work according to your specifications.

If you believe that any content available on our platform infringes on any copyrighted material that you own or control, you should file a notice and promptly notify us at info@aposbook.com. We will investigate the matter, and if your claims are found to be true, we will remove the content immediately.

When filing a notice, you should provide us with:

  • Your contact information
  • A link to or source for the copyrighted material
  • The location of the material on our platform
  • A statement saying that you did not give the person permission to use your content
  • A statement, under legal penalty, that the information you provided us is true
  • Your signature or that of your authorized agent

If you send us incomplete information, we cannot process your request.

If you have been accused of copyright infringement, we will notify you immediately.

If you believe the claim is false, you have the right to file a counter-notice and contact us at info@aposbook.com. You can also contact the person who made a request to take down the material.

If you want to file a counter-notice, you should provide:

  • Your contact information
  • A link to or source for the copyrighted material
  • The location of the removed material on our platform
  • A statement saying that you did not infringe on anyone’s rights by using the material and the information you are providing is true, under legal penalty
  • A statement that you accept the authority and help of the courts and legal services in your area 
  • Your signature or that of your authorized agent 

You may withdraw a takedown notice at any time. Make sure to provide us with:

  • The same email address you used to file the request
  • The original takedown request, including the date you sent it to us
  • Any counter-notice that was filed with it
  • Include the following: “By this request, I hereby withdraw my claim of copyright infringement…”
  • Your signature or that of your authorized agent
  • Users of our Services who repeatedly infringe upon the intellectual property of others may have their accounts terminated.

6- Links To Other Websites

AposBook may contain links to third-party websites or services that we do not own or control.

AposBook has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that Aposbook shall not be responsible or liable, in any way, for anything that occurs when you access content or services available on or through third-party websites.

7- Limitations of Liability

Read this section carefully since it limits the liability of AposBook to you.

WE ARE PROVIDING YOU THE APOSBOOK PLATFORM AND ITS SERVICES SO YOU CAN CONNECT WITH OTHERS, EXCHANGE KNOWLEDGE, AND SHARE CONTENT ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. AS SUCH, TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, APOSBOOK ALSO EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS RELATED TO MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Therefore, AposBook makes no warranty that:

  • The Services on the platform will meet your requirements.
  • The Services on the platform will be uninterrupted, timely, secure, or error-free.
  • The information you receive from AposBook or any other user on the platform will be accurate or reliable.
  • The quality of any services, information, or other material on the AposBook platform will be up to your standards.

If you are not satisfied with our Services, your sole remedy is to stop using AposBook.

Furthermore, you agree that, to the maximum extent permitted by law, AposBook will not be liable for any events that are or may be connected to your use or inability to use our platform.

This applies even if we have foreseen the possibility of such damages occurring.

Therefore, we are not responsible for:

Indirect, incidental, consequential, special, or exemplary damages

  • Loss of profits
  • Business interruption
  • Reputational harm
  • Loss of data

8. Code Of Conduct

We are a social and professional community, so please be mindful of what you say or do on the platform. Your words and actions might impact others in a way that you may be unaware of, so you should remember to always act in a civil manner.

You might also influence people’s opinions or decisions without knowing it, so you need to always make sure the information you provide on the platform is accurate and true.

When writing a post or comment or uploading a video online, ask yourself if it would be okay for you to say that if you were standing face to face with someone else in real life. If it is not, do not do it. 

Keep in mind that when interacting with other members, you may encounter people who have different views, affiliations, or beliefs than you do. Be aware of sensitive, personal topics or matters related to values and beliefs.

Remember that it is okay for people to have opinions different than your own. You might learn something from them. Respecting others is one of the key aspects of a healthy and productive dialogue.

When using the Services, you agree to be trustworthy and:

  • Use your real name and provide accurate information on your profile.
  • Abide by all Internet laws and regulations, including data privacy and security laws that may apply to your country of residence.

8.1 Our Values:

A- Trust

You should not abuse the community’s trust and:

  • Provide false information or use a fake identity when you register for an account
  • Use or attempt to use another person’s account in any way
  • Disclose other people’s confidential information without their consent
  • Violate other users’ intellectual property rights by copying or distributing other users’ content without their permission (except when you “Share” content or “copy and paste” links to the content)
  • Post software viruses, worms, or any harmful code on the platform
  • Disrupt communication on the platform by hijacking or spamming discussions
  • Abuse your right to report others

B. Professionalism

  • To keep the platform professional, you will:
  • Be kind, respectful, dignified, and ethical when interacting with other users
  • Moderate discussions peacefully
  • Respect people’s privacy

C. Expanding Knowledge

We do not want to overwhelm others with large amounts of random information. Users need to bear in mind that each page is a complete “Knowledge Center,” and has a  dedicated community forum assigned to it.

As such, we kindly ask you to use the appropriate feedback section when asking questions, commenting on other material, or introducing new topics for discussion.

Therefore, when contributing to community learning, you will:

  1. Share content you find interesting with other users to promote and spread knowledge. If you publish content you wrote and you are using information from other references, be sure to mention your sources to facilitate the spread of accurate information.
  2. Share your personal experience or expertise with others, so you give back to the community.

For example,

  • If you wish to discuss a particular solution in general, you can do so on the general solution page.
  • If you wish to discuss the same solution, but you want to talk about how it treats a specific medical condition or case, you can do so on the community page dedicated to this.
  • If you want to discuss the condition in general, make sure you go to the condition page.

This will help keep the platform organized and easy to navigate. 

D. Safety

To keep the AposBook community safe, you WILL NOT:

  1. Threaten anyone with violence in any way or encourage violence against others
  2. Threaten or promote terrorism or extremism
  3. Harass anyone or encourage other people to do so
  4. Discriminate or encourage hateful behavior against people because of their race, ethnicity, nationality, sexual orientation, gender, religious affiliation, age, income status, disability, or medical condition.
  5. Promote and encourage suicide or self-harm
  6. Post sensitive material such as graphic content which depicts extreme violence, contains adult material, or portrays sexual violence or assault
  7. Use our Services illegally or promote illegal activity

We ask our members to act responsibly and report anything that may violate our “Code of Conduct” or the “Terms of Use.” You may flag inappropriate comments or report users that do not abide by our “Code of Conduct.” AposBook will investigate your  report and decide what to do with the user account  accordingly.

Your account may be suspended or terminated if you do not abide by the “Code of Conduct.”

9. Account Termination

We want AposBook to be a safe place where people feel welcome. We want to encourage them to express themselves and share their thoughts and ideas with others.

If we determine that you have clearly, seriously, or repeatedly breached our “Terms” or “Policies,” including violating our “Code of Conduct,” we may suspend or permanently disable access to your “Account.”

We may also suspend or disable your “Account” if you repeatedly infringe other people’s intellectual property rights or where we are legally required to do so.

If we disable or terminate your “Account,” we will let you know and explain the options you have to request a review. We can deny your request to activate your Account if it may expose us or others to legal liability, harm our users, and compromise, or interfere with the integrity or operation of any of our services and systems.

We can also deny your request if we have technical restrictions or if we are forbidden from doing so for legal reasons.

If your Account is terminated:

  • We can still use your feedback
  • Users can still share and comment on your content on the platform
  • Sections 3, 7, 8, 10 and 11 of this Agreement still apply

10. Indemnification

You agree to release, indemnify, and defend AposBook against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from: (a) your use of the Services, (b) any Content you post or upload, (c) your use of any Content, or (d) your violation of these Terms and Conditions.

11. Disputes

In case you have a problem with us or the way we operate, first try to resolve it by contacting or emailing us at info@aposbook.com. If you and AposBook are unable to resolve the dispute by direct communication, and if you both agree to do so, you or Aposbook may submit any dispute arising out of this Agreement to any court in the country that has jurisdiction over this claim. The court will fully implement the intent and purposes of this agreement.

12. General Terms

- Assignment: Aposbook may assign this Agreement, in whole or in part, in its sole discretion. You may not assign your rights under this Agreement without AposBook’s prior written permission. Any attempt at doing so will be considered invalid.

- Waiver of Breach: Any failure to enforce any term or condition of this Agreement shall not be deemed a waiver or a breach of the terms of this Agreement, whether now or in the future.

- Invalidity: If any condition in this Agreement is held or considered to be invalid or unenforceable because it conflicts with legal regulations, it will be modified so that it would be valid and enforceable. If, for any reason, it cannot be changed, you can ask the court to remove the invalid part but still enforce the rest of the Agreement.

- Users outside the United States: AposBook expressly disclaims any warranty that the Aposbook Platform complies with all applicable laws outside of the United States. If you use the Aposbook Platform in a foreign country, you clearly understand and agree that you are responsible for determining how different laws may apply to you when you use the Aposbook Platform.

13. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will give your prior notice on our Services to review the changes. The changes cannot be retroactive, and we determine what constitutes a substantial change at our sole discretion.
